These Terms and Conditions ("Terms") govern your use of the Wild Roots website, programs, services, content, and related offerings (collectively, the "Services").

By accessing, purchasing, or participating in our Services, you agree to these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree with these Terms, please do not use or purchase our Services.

Wild Roots provides online educational and wellness programs, coaching, resources, and related services focused on sleep, wellbeing, lifestyle, and personal development.

2. ELIGIBILITY AND ACCEPTABLE USE

Our Services are intended for adults aged 18 and older.

By using our Services, you represent that you are at least 18 years old, have the legal capacity to enter into an agreement, and will provide accurate information when required.

You agree not to:

use the Services for unlawful or fraudulent purposes;

share, copy, reproduce, resell, or commercially exploit our content without permission;

share your account or program access with others;

attempt to gain unauthorized access to our systems or other users' information; or

interfere with the security or operation of the Services.

We may suspend or terminate access if these Terms are violated.

3. WELLNESS AND HEALTH DISCLAIMER

Wild Roots provides educational and wellness information and coaching.

Our Services are not intended to provide medical diagnosis, treatment, or care and are not a substitute for advice from a qualified healthcare professional.

Wild Roots does not instruct participants to stop, change, or replace medication or medical treatment.

If you have a medical condition, take medication, experience significant or persistent symptoms, or have concerns about your health or sleep, you should consult an appropriate qualified healthcare professional.

You are responsible for determining whether our Services are appropriate for you.

4. RESULTS AND TESTIMONIALS

We do not guarantee any particular outcome, result, or improvement from participating in our Services. Individual experiences vary.

Testimonials and other customer experiences presented on our website, in our marketing, or within our Services reflect the experiences of the individuals who provided them and are provided for informational purposes. They are not a guarantee or representation that other customers will achieve the same results.

We only use testimonials and endorsements that we have permission to use and that reflect the person's genuine experience with our Services.

5. PURCHASES, PAYMENT, AND REFUNDS

Prices, payment terms, applicable taxes or fees, and the specific terms of each program or service will be disclosed before purchase.

Payments may be processed through third-party payment providers. By submitting a payment, you authorize the applicable charge according to the terms presented at checkout or before purchase.

If a program includes payment plans or recurring payments, the applicable price, frequency, duration, and cancellation terms will be disclosed before purchase.

Refund and Cancellation Policy:

Due to the nature of our Services, payments are generally non-refundable once the program has started.

However, Wild Roots offers a Results Guarantee. If you actively participate in the program, follow at least 85% of the strategies and recommendations agreed upon with your coach, and do not achieve the applicable program results, Wild Roots will continue providing reasonable program support at no additional cost beyond the original program period, until the applicable results are achieved.

To qualify for the Results Guarantee, you must have consistently participated in the program, implemented the agreed recommendations, and completed the required tracking or check-ins used to assess your progress.

The Results Guarantee does not provide an automatic refund and does not apply if the participation and implementation requirements are not met.

Any mandatory consumer rights that cannot legally be waived remain unaffected.

6. PROGRAM ACCESS AND INTELLECTUAL PROPERTY

When you purchase access to a Wild Roots program or service, you receive a limited, personal, non-exclusive, non-transferable right to access and use the materials for your own educational purposes.

Unless we give you written permission, you may not:

reproduce or distribute our materials;

share your access with another person;

resell or sublicense our content;

publish our materials online or elsewhere; or

use our content for commercial purposes.

All Wild Roots content, including programs, materials, written content, videos, recordings, frameworks, and other original materials, remains the property of Wild Roots or its licensors.

7. CALLS, RECORDINGS, AND THIRD-PARTY SERVICES

Some Services may include calls, group sessions, or communications conducted through third-party platforms such as Zoom.

Sessions may be recorded and stored for purposes related to providing, managing, or improving the Services. Where required by applicable law, appropriate notice or consent will be obtained.

We may also use third-party providers for payment processing, communications, hosting, program delivery, analytics, scheduling, and other business operations. Your use of those services may also be subject to their own terms and privacy policies.

8. COMMUNITY CONDUCT

If our Services include a community, group, messaging channel, or similar environment, you agree to interact respectfully and lawfully.

You may not harass, threaten, impersonate, or abuse other participants, disclose another participant's private information, or use the community for unlawful solicitation or other inappropriate purposes.

We may remove content or restrict access when reasonably necessary to protect the community or enforce these Terms.

9. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that the website or Services will always be available, uninterrupted, error-free, or suitable for every individual.

We make reasonable efforts to provide useful and accurate information but do not guarantee that all content will always be complete, current, or free from errors.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Wild Roots will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Services.

To the extent permitted by law, Wild Roots' total liability relating to a particular purchase or service will not exceed the amount you paid for that service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

11. CHANGES AND TERMINATION

We may update these Terms from time to time. The updated version will be posted on this website with a revised "Last Updated" date.

We may suspend or terminate access to the Services when reasonably necessary, including in cases of violation of these Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

These Terms are governed by the laws applicable in the State of New Mexico, United States, except where mandatory consumer protection laws in your place of residence provide otherwise.
